Terms of Service

1. Acceptance of terms

By accessing or using the Fami platform (hereinafter, "the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any of the conditions set forth herein, please do not use the Service.

These Terms constitute a legal agreement between you (either as an individual or on behalf of a legal entity) and Fami. Your continued use of the Service after any modification implies acceptance of the new terms.

2. Description of service

Fami is a software-as-a-service (SaaS) platform designed for the comprehensive management of residential neighborhoods, condominiums, and communities. Features include: maintenance fee payment management, access control and security, communication between residents and administration, and visitor management.

Fami reserves the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice, without incurring any liability to you or third parties.

3. Accounts and registration

To access the Service you must create an account providing truthful, complete, and current information. You are responsible for maintaining the confidentiality of your access credentials and for all activities that occur under your account.

If you detect unauthorized use of your account, you must notify us immediately through the support channels listed in the Contact section. Fami will not be liable for damages arising from your failure to comply with this obligation.

Fami reserves the right to suspend or cancel accounts that violate these Terms, without prior notice and without liability.

4. Subscriptions, payments, and free trial

The Service is offered through monthly or annual subscriptions under the Basic, Standard, Pro, Class, and Elite plans. All prices are expressed in Mexican Pesos (MXN) and include applicable Value Added Tax (VAT) under current Mexican law, unless otherwise stated.

Fami offers a free trial of 15 (fifteen) calendar days from the registration date. During this period, you will have access to the features of the selected plan at no charge. Upon conclusion of the free trial, a subscription payment is required to continue using the Service; otherwise, the account will be suspended until payment is made.

Payments are recurring and will be charged automatically at the start of each billing period. Fami will not issue refunds for payments made, except in cases expressly provided by law or at Fami's discretionary decision duly communicated to the user.

Fami reserves the right to modify plan prices with a minimum of 30 (thirty) calendar days' advance notice. Continued use of the Service after new prices take effect will constitute your acceptance.

5. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. The following are expressly prohibited:

• Using the Service for illegal or fraudulent activities.
• Attempting unauthorized access to Fami's or third-party systems, data, or networks.
• Transmitting viruses, malware, or other harmful code.
• Collecting data from other users without their consent.
• Reselling, sublicensing, or transferring access to the Service to unauthorized third parties.
• Reverse engineering, decompiling, or attempting to extract the platform's source code.

6. Intellectual property

All intellectual property rights in the Service, including its source code, design, logos, trademarks, text, and interfaces, are the exclusive property of Fami or its licensors. These Terms do not grant you any ownership rights in the Service or any of its elements.

You retain ownership of the data and information you upload to the platform. By doing so, you grant us a limited, non-exclusive, and revocable license to process that information solely for the purpose of providing the Service.

7. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation will take effect at the end of the current billing period; access to the Service will remain active until that date. No refunds will be issued for unused time within the paid period.

Fami may cancel or suspend your access to the Service, with or without prior notice, in the event of a breach of these Terms, non-payment, or fraudulent use. In such cases, no refund will be due.

8. Limitation of liability

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

In no event will Fami, its directors, employees, partners, or suppliers be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from the use of or inability to use the Service, even if advised of the possibility of such damages.

Fami's total liability to you for any claim arising from these Terms or the use of the Service will not exceed the amount paid by you to Fami during the three (3) months prior to the event giving rise to the claim.

9. Service modifications

Fami reserves the right to update, modify, or discontinue any aspect of the Service at any time. When changes are substantial, we will notify you at least 15 (fifteen) calendar days in advance by email or a prominent notice within the platform.

Fami may also modify these Terms of Service at any time. The current version will always be available on this page. Continued use of the Service after changes are published will constitute your acceptance of those changes.

10. Governing law

These Terms are governed by and construed in accordance with the laws of the United Mexican States, without giving effect to its conflict-of-laws provisions. The parties expressly submit to the jurisdiction of the competent courts of [City], Mexico, waiving any other jurisdiction that may apply by reason of their current or future domicile.

In the event of a dispute, the parties will attempt to resolve it amicably within 30 (thirty) calendar days before resorting to judicial proceedings.
